02Definitions
- "Boli", "we", "our"
- Boli Care SAS, publisher of the Website.
- "Website"
- The website published at boli.care, including all sub-domains and language versions (EN / FR / ES).
- "User", "you"
- Any person accessing or browsing the Website, whether as a visitor, prospective patient, healthcare professional or partner.
- "Application"
- The Boli Care medical-device software for patients (mobile app), including paid features accessed through in-app subscriptions. Use of the Application is also governed by the Instructions for Use and applicable medical-device labelling.
- "Content"
- All information, texts, graphics, logos, icons, images, videos, software and source code published on the Website.
- "Consumer"
- A natural person acting for purposes outside their trade, business or profession, within the meaning of the EU Consumer Rights Directive 2011/83/EU and the French Consumer Code.
03Purpose of the Website
The Website provides general information about Boli, a digital-health company building clinical infrastructure for AOM-based obesity care, and in particular for people treated with anti-obesity medications.
The Website also presents the company's mission, values and upcoming products. It may offer access to articles, press releases, community updates and the option to join a mailing list.
The Website does not provide personalised medical advice, diagnosis or prescription, and does not replace professional healthcare services.

05Boli Care Application
In addition to the Website, Boli offers the Boli Care Application, a Class I software medical device for adults living with obesity, in particular those treated with anti-obesity medications. The Application is intended as a support tool between medical consultations; it does not replace your healthcare professional.
By creating an account, downloading or using the Application, you agree to these Terms, our Privacy Policy, and the Instructions for Use. You must be at least 18 years old (or the age of majority in your country) to use the Application.
Some features require a paid subscription. Free features, trial periods (if offered) and subscription plans are described in the Application and in the store listing at the time of purchase.
06Auto-renewable subscriptions (in-app purchases)
Access to certain Application features is provided through auto-renewable subscriptions sold via the Apple App Store (iOS) and, where available, Google Play (Android). The applicable store is the merchant of record for payment, billing and refunds.

Payment and renewal. Payment is charged to your Apple ID or Google account at confirmation of purchase. Unless you turn off auto-renewal at least 24 hours before the end of the current billing period, the subscription renews automatically and your account is charged for renewal within 24 hours before the period ends, at the price in effect for that plan (subject to store price changes communicated in advance).
Managing or cancelling. You can view, change or cancel subscriptions in your device account settings: on iOS, Settings > Apple ID > Subscriptions; on Android, Google Play > Payments & subscriptions > Subscriptions. Deleting the Application does not cancel an active subscription.
Free trials. If a free trial is offered, its duration and eligibility are shown in the store. Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable under store rules.
Refunds and withdrawal. Refund requests for in-app purchases must be submitted to Apple or Google through their respective support channels. Boli cannot process refunds for store billing. If you are a Consumer in the European Union, you may have a statutory right of withdrawal for distance contracts; for digital content supplied immediately after purchase with your prior express consent, that right may be limited once performance has begun, as permitted by applicable law and store terms.

07Access to the Website
The Website is accessible to anyone with an internet connection. Boli aims to keep the Website available 24/7, except in case of maintenance, force majeure or system failures. Boli reserves the right to modify, suspend or restrict all or part of the Website without prior notice.
Access to the Website is free of charge, with the exception of the costs charged by your internet service provider, which remain at your expense.
08User obligations
By using the Website you agree to:
- Use the Website for lawful and personal purposes only.
- Not transmit, distribute or upload any harmful content (viruses, malware, defamatory, illegal or infringing material).
- Not attempt to disrupt, probe or compromise the integrity, security or performance of the Website or its associated systems.
- Not extract, copy or reuse the Content of the Website without our prior written consent, beyond what is permitted by law.
- Respect the rights of third parties (intellectual property, privacy, dignity).
09Intellectual property
All elements of the Website (texts, graphics, logos, icons, images, videos, software, source code, etc.) are protected by intellectual-property law and are the exclusive property of Boli or its authorised partners.
You are granted a personal, non-transferable and non-exclusive right to access and use the Website in accordance with these Terms. Any unauthorised reproduction, representation, distribution or adaptation is strictly prohibited and may give rise to civil and criminal sanctions under articles L.335-2 et seq. of the French Intellectual Property Code.
"Boli" and "Boli Care" are trademarks of Boli Care SAS. Other trademarks mentioned on the Website are the property of their respective owners.
10Liability
Boli endeavours to ensure that the Website is accurate and up to date but does not guarantee the accuracy, completeness or relevance of the information provided.
To the fullest extent permitted by law, Boli cannot be held liable for:
- Any direct or indirect damages resulting from the use or inability to use the Website;
- Errors or omissions in the Content;
- Technical issues or temporary unavailability;
- Damages caused by a third party or by a use of the Website that is not consistent with these Terms.
11Links to third-party sites
The Website may contain hyperlinks to third-party sites or services. These links are provided for convenience only. Boli has no control over the content or availability of these sites and disclaims all responsibility for their use, content or data-protection practices.
12Personal data
Use of the Website may involve the collection and processing of personal data. This is governed by our Privacy Policy, in accordance with applicable data-protection laws (GDPR, Loi Informatique et Libertés, CNIL guidelines).
You have the right to access, rectify and delete your data, as well as the other rights described in the Privacy Policy. For any request, contact privacy@boli.care.
14Digital Services Act
In accordance with Regulation (EU) 2022/2065 (the "Digital Services Act"), the following information applies:

16Severability & entire agreement
If any provision of these Terms is found to be invalid, illegal or unenforceable, the validity of the remaining provisions shall not be affected. These Terms, together with the Privacy Policy, the Cookie Policy and the Legal Notice, constitute the entire agreement between you and Boli regarding the use of the Website and the Application.
The failure by Boli to enforce any right or provision under these Terms shall not be deemed a waiver of such right or provision.
17Law & jurisdiction
These Terms are governed by and construed in accordance with French law. Any dispute relating to the formation, interpretation or performance of these Terms shall be submitted to the competent courts of Bayonne, France, subject to mandatory legal provisions to the contrary.
If you are based in France, before any judicial action you may also refer the matter to a consumer mediator.
